Welcome to VolkovDIGITAL. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services. By accessing our website, using our applications, or engaging our services, you agree to be bound by these Terms.

1. Definitions

• "Company," "we," "us," or "our" refers to MAKSIM VOLKOV IE (Individual Entrepreneur), operating under the trade name VolkovDIGITAL
• "Services" refers to mobile application development, SEO services, ASO services, and any related services we provide
• "Applications" or "Apps" refers to mobile applications developed and published by VolkovDIGITAL
• "User," "you," or "your" refers to any individual or entity using our Services, website, or Applications
• "Content" refers to all text, images, code, data, and other materials provided through our Services

2. Services Overview

VolkovDIGITAL provides the following services:

• iOS Application Development: Native iOS applications using Swift and SwiftUI
• Android Application Development: Native Android applications using Kotlin and Jetpack Compose
• Search Engine Optimization (SEO): Website optimization for search engines
• App Store Optimization (ASO): App store visibility optimization
• Mobile Applications: Consumer-facing applications published on App Store and Google Play

The specific scope, deliverables, and terms for each development project will be outlined in a separate agreement or proposal.

3. Acceptance of Terms

By accessing our website, downloading our applications, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website, applications, or services.

4. Mobile Applications Terms

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile applications for your personal, non-commercial purposes.

4.2 Restrictions

You agree not to:

• Copy, modify, or distribute the application
• Reverse engineer, decompile, or disassemble the application
• Remove any copyright or proprietary notices
• Use the application for any unlawful purpose
• Transfer your license to another party
• Use automated systems or bots with our applications

4.3 In-App Purchases and Subscriptions

Some applications may offer in-app purchases or subscriptions:

• All purchases are final and non-refundable, except as required by applicable law
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may change with notice; existing subscriptions maintain their price until renewal
• Refunds for App Store purchases must be requested through Apple
• Refunds for Google Play purchases must be requested through Google

4.4 Updates and Changes

We may update our applications from time to time. Updates may be required to continue using the application. We are not obligated to provide updates or maintain backwards compatibility.

5. Development Services Terms

5.1 Client Responsibilities

When engaging our development or SEO services, you agree to:

• Provide accurate and complete information necessary for the project
• Respond to communications and requests in a timely manner
• Make payments according to the agreed schedule
• Provide necessary access to systems, accounts, or materials as required
• Review and provide feedback on deliverables within agreed timeframes
• Ensure you have rights to any materials you provide to us

5.2 Intellectual Property

Upon full payment:

• Clients receive ownership of custom code, designs, and other deliverables created specifically for their project, unless otherwise specified
• VolkovDIGITAL retains the right to use general techniques, knowledge, and non-confidential elements in future projects
• We may use project descriptions and non-confidential information for portfolio purposes unless agreed otherwise

5.3 Confidentiality

We respect the confidentiality of your business information. Any confidential information shared during our engagement will be protected and not disclosed to third parties without your consent, except as required by law.

5.4 Payment Terms

Payment terms will be specified in individual project agreements. Unless otherwise agreed:

• A deposit of 30-50% may be required before work begins
• Invoices are due within 14 days of issuance
• Late payments may result in project delays, suspension, or late fees
• All fees are non-refundable once work has commenced

5.5 Project Modifications

Changes to project scope, timeline, or deliverables after the agreement is signed may result in additional charges. All changes must be agreed upon in writing.

6. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit any harmful code, viruses, or malware
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our services
• Use our services for spam, harassment, or illegal activities

7. Warranties and Disclaimers

7.1 Service Warranty

We strive to deliver high-quality work and services. However:

• Services are provided "as is" without warranties of any kind, express or implied
• We do not guarantee specific SEO rankings or traffic increases
• App Store or Google Play approval is subject to platform guidelines and is not guaranteed
• We do not guarantee uninterrupted or error-free operation of applications

7.2 Third-Party Services

Our services may integrate with or depend on third-party services (Apple, Google, payment processors, etc.). We are not responsible for the availability, functionality, or policies of these third-party services.

8. Limitation of Liability

To the maximum extent permitted by law:

• VolkovDIGITAL shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
• We are not liable for any loss of data, profits, or business opportunities
• These limitations apply regardless of the legal theory of the claim

9. Indemnification

You agree to indemnify, defend, and hold harmless VolkovDIGITAL, its owner, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of our services or applications
• Your violation of these Terms
• Your infringement of any third-party rights
• Any content you provide or submit

10. Termination

10.1 Application License Termination

Your license to use our applications terminates automatically if you violate these Terms. Upon termination, you must cease all use and delete the application.

10.2 Service Agreement Termination

Either party may terminate a service agreement with written notice. Upon termination:

• Payment is due for all work completed up to the termination date
• Completed deliverables will be transferred upon payment
• Both parties must return or destroy confidential information

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be:

• First, attempted to be resolved through good-faith negotiation
• If negotiation fails, submitted to mediation
• If mediation fails, resolved through the courts of the Republic of Armenia

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Armenia, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with any separate service agreements, constitute the entire agreement between you and VolkovDIGITAL regarding the subject matter hereof.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated revision date. Your continued use of our services constitutes acceptance of the modified Terms.
